Blubuilds LLC — a Kentucky limited liability company

These Terms and Conditions (these "Terms") form a binding legal agreement between you ("you," "your," or the "User") and Blubuilds LLC, a Kentucky limited liability company ("Blubuilds," "we," "us," or "our"), governing your access to and use of the Yumzy mobile application together with all of its features, functionality, content, recipes, meal plans, grocery lists, and related services (collectively, the "App").
By downloading, installing, accessing, or using the App, or by tapping "get started," "continue," "build my plan," or any similar button, you acknowledge that you have read and understood these Terms and that you agree to be bound by them and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not download, install, access, or use the App.
PLEASE READ SECTION 22 (DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER) CAREFULLY. IT REQUIRES YOU AND BLUBUILDS TO RESOLVE MOST DISPUTES THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR JURY TRIAL, EXCEPT AS DESCRIBED IN THAT SECTION. YOU HAVE A RIGHT TO OPT OUT OF ARBITRATION AS SET FORTH IN SECTION 22.5.
"App" means the Yumzy application and all associated software, features, content, recipes, meal plans, grocery lists, designs, graphics, characters, and services made available by Blubuilds.
"Apple" means Apple Inc. and its subsidiaries.
"App Store" means the Apple App Store through which the App is distributed.
"Device" means the Apple-branded mobile device that you own or control and on which the App is installed.
"User Inputs" means the information, selections, and content you enter into or generate within the App, including your chosen store, weekly budget, household size, meal preferences and counts, dietary selections, kitchen appliances, custom grocery items, and similar data.
"Subscription" means any auto-renewable subscription, in-app purchase, or other paid offering that Blubuilds may make available within the App, now or in the future.
The App is intended for users who are at least 13 years of age. By using the App, you represent and warrant that you are at least 13 years old.
If you are at least 13 years old but under the age of 18 (or the age of legal majority in your jurisdiction), you may use the App only with the knowledge, supervision, and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. A parent or guardian who permits a minor to use the App accepts full responsibility for the minor's use and for ensuring compliance with these Terms.
The App is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at the address in Section 33 so that we can take appropriate action.
By using the App, you further represent and warrant that you are not barred from using the App under the laws of the United States or any other applicable jurisdiction, and that your use complies with all applicable laws and regulations.
